Change Of Use From Commercial To Residential Class MA
In the UK, certain commercial-to-residential conversions can be carried out under permitted development rights (PDR), specifically under class MA of the General Permitted Development Order (GDPO) 2015 (as amended). This allows you to convert some commercial buildings into residential use without needing full planning permission, but you must still apply for “prior approval” from your local planning authority, which DWG Plans can help with.

What change is allowed?
From:
- Class E (commercial, business and service) – includes shops, offices, restaurants, gyms nurseries, etc.
To:
- Class C3 (Residential dwellings)
Key requirements for Class MA
- Eligibility Criteria
- Property must have been in Class E use for at least 2 years before the application.
- The building must be vacant for 3 continuous months before the prior approval application.
- Applies only to buildings under 1500 square metres
- Location Restrictions – not permitted if the building is:
- In a site of special scientific interest (SSSI)
- In a listed building
- In a safety hazard area
- In National Parks, Areas of Outstanding Natural Beauty (AONB) or World Heritage Sites.
- In certain Article 4 areas (Where councils restrict PDR’s)
- Prior Approval Mus Cover:
You must submit a prior approval application, which will be assessed for:
- Transport and impact on highways
- Contamination risks
- Flood risk
- Noise impact from nearby commercial uses.
- Provision of adequate natural lights.
- Fire safety (for buildings over 18m in height of 7+ storeys)
- Impact on existing business operations nearby
Application Requirements – You will need to submit:
- Application form for prior approval
- Existing and proposed floor plans
- Evidence the building has been vacant for 3 months
- Details of Class E use history
- Any required assessments (flood risk, noise, transport, etc.)
- Application fee

- Space standards apply: All new homes must meet the Nationally Described Space Standards.
